Provincial vs Municipal Rules

Minimum Height Requirements

  • Most Ontario municipalities: 48 inches (1.2m) minimum fence height

Gate Requirements

Pool fence gates are the most commonly failed inspection item. Requirements include:

  • Self-closing mechanism: Gate must close automatically from any open position
  • Self-latching hardware: Latch must engage without manual intervention
  • Latch height: Must be out of reach of young children (typically 54" from ground)
  • Swing direction: Gate must swing outward (away from pool area)
  • No locks that can be bypassed: Padlocks alone are not compliant

Anti-Climb Design

Pool fences must be "non-climbable." This means:

  • No horizontal rails on the exterior (pool-facing side is fine for some designs)
  • No footholds between 100mm and 900mm from the ground
  • Vertical pickets or glass panels are the safest options

This is why glass pool fences are increasingly popular — they inherently meet the non-climbable requirement while providing unobstructed sightlines for supervision.

Glass Pool Fence Specifics

  • Glass type: Must be tempered or laminated safety glass (CSA A500)
  • Thickness: 10mm minimum, 12mm recommended for larger panels
  • Gap restrictions: No gap greater than 100mm between panels or at the base
  • Hardware: Marine-grade stainless steel (316 grade) for corrosion resistance
